LIMITED WARRANTY ON NEW PRODUCTS
WHAT IS COVERED BY THIS WARRANTY?
Fitness Cubed Inc. (“Fitness Cubed”) warrants to you, the original retail purchaser (“Consumer”), that the Cubii compact seated elliptical (“Product”) will, under normal use, operate substantially in accordance with the Product specifications for a period of one (1) year from date of original purchase by the Consumer (“Warranty Period”). The consumer’s sole and exclusive remedy under this warranty will be, at Fitness Cubed’s option, either to repair, provide replacement parts, or replace the Product so that it performs substantially in accordance with the Product specifications. The Warranty Period is not extended if we replace a warranted Product or any part(s), except where required by applicable law. Because Fitness Cubed cannot control the quality of products sold by unauthorized sellers, this limited warranty applies only to Products that were purchased from Fitness Cubed or a Fitness Cubed authorized seller, unless otherwise prohibited by law.
WHAT IS NOT COVERED BY THIS WARRANTY?
The foregoing warranty is limited and is not applicable to: (i) normal wear and tear; (ii) defects or damage caused by misuse; accident (including, without limitation, collision, fire, and the spillage of food or liquid); neglect; abuse; alteration; unusual stress; modification; improper or unauthorized repair, installation, wiring, or testing; improper storage; use of an unapproved device; if the serial number has been removed or altered; (iii) use not in accordance with the Product specifications and documentation accompanying the Product; or (iv) damage caused by the equipment with which the Product is used. This limited warranty does not apply to any non-Fitness Cubed products or unauthentic products or accessories. Fitness Cubed reserves the right to reject warranty claims from purchasers for Products purchased from unauthorized sellers, including unauthorized Internet sites. HOW TO OBTAIN WARRANTY SERVICE
To report an issue that is applicable under the warranty, please contact our team at 1300 799 418 or email customerservice@tribesetters.com.au.. Please select the appropriate form that reflects the issue you are experiencing and fill out the form in its entirety. You must provide, either through the form or otherwise, (i) your order number, (ii) Product serial number, (iii) the name of the seller from whom you purchased the product, (iv) proof of purchase, and (v) description of the issue along with any supporting photos or videos. If you choose to mail us these items, postage will be at your cost. Please be advised you may be required to return the Product to Fitness Cubed, and this will be done at Fitness Cubed’s cost.
WARRANTY LIMITATIONS SUBJECT TO CONSUMER LAW
Except where prohibited by applicable law, this limited warranty extends only to the Consumer and is not assignable or transferable to any subsequent purchaser or user. TO THE EXTENT PERMITTED BY LAW, THE LIMITED WARRANTY SET FORTH ABOVE IS PROVIDED IN LIEU OF ALL OTHER WARRANTIES, AND FITNESS CUBED HEREBY DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, QUALITY, AND TITLE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FITNESS CUBED ALSO LIMITS THE DURATION OF ANY APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO EVENT WILL FITNESS CUBED BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT, AND FITNESS CUBED’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCT BY THE ORIGINAL PURCHASER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. Fitness Cubed does not warrant that the Product is error-free or that it will function without interruption. To the extent that Fitness Cubed may not, as a matter of applicable law, disclaim certain implied warranties, the duration of any such implied warranty shall be limited to the shorter of the one (1) year limited warranty period or the minimum time period permitted under such law. Some jurisdictions do not allow limitations on the duration of implied warranties, so the above limitation may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights that vary from jurisdiction to jurisdiction. Where any term of this warranty is prohibited by such laws, it shall be null and void, but the remainder of the warranty shall remain in effect.
